Terms & Conditions
-
By booking a session, web design project, template tweak, or tech support with Sarah Foubert, trading as foubography, you agree to the following terms and conditions. These are designed to ensure clarity, fairness, and a transparent, collaborative experience for both of us.
1. Estimates, Booking & Deposits
Project Proposals: Estimates and project packages are valid for 30 days from the date issued.
The 50% Deposit: To secure your design slot and begin The Chat & The Plan phase, a non-refundable 50% deposit of the total project fee is required. Work will not commence until this deposit is cleared and the digital agreement is signed.
Final Balance: The remaining 50% balance is due upon final layout approval and must be paid in full before ownership of the site is transferred, or before the site is launched live.
2. Project Scope & Extras
Standard Packages: Project fees cover the specific deliverables outlined in your chosen tier (One Page Website, Standard Website, or Advanced Website).
Project Extras: Any additional features requested outside the initial agreement (such as opening an online shop, sorting bookings in the background, adding a blog, custom coding, or implementing multilingual setups) will be quoted separately or added to your final invoice.
3. Client Content & Delays
A web project can only move as fast as the content provided. You are responsible for delivering all text copy, high-resolution branding assets, and photography selections required to populate the site.
Project Stalling: If a project is delayed by more than 30 days due to missing client content, I reserve the right to pause the project, invoice for work completed to date, and require a re-booking fee to place you back into my design schedule.
4. Design Concepts & Revisions
The Process: During The First Look and The Polish & The Tech phases, you will be given up to three (3) initial design concepts and two (2) subsequent rounds of revisions to your chosen layout.
Out-of-Scope Revisions: Extensive structural changes, a complete switch in design direction after approval, or extra revision rounds beyond the initial two will be billed at a flat rate from £125 per design round, or charged at my standard hourly tech rate.
5. Third-Party Fees & Squarespace
Platform Subscriptions: Any ongoing costs associated with running your website (including Squarespace hosting plans, custom domain registrations, email marketing subscriptions, or premium plugin extras) are paid directly by you, the Client.
Account Setup: These subscriptions must be maintained by you to keep your digital hub live. I am not liable for site interruptions caused by lapsed platform payments.
6. Technical Support & "Life After Launch"
The Handover: Once we complete The Launch & Beyond phase, your site is handed over entirely to you.
Post-Launch Support: Free ongoing maintenance is not included in project packages. If you need support downstream, you can book standard support assets through my ecosystem:
7. Cancellations & Project Termination
Early Termination: Because design slots are strictly limited, if you decide to cancel the project before completion, the initial 50% deposit is completely non-refundable.
Mid-Project Cancellation: If a project is terminated by either party midway through development, you will be invoiced for the specific hours or milestone phases completed up to that date.
The Stepping-Stone Method: For phased builds, work can be formally paused by mutual agreement at the end of a completed phase without penalty.
8. Intellectual Property & Ownership
Transfer of Rights: Full ownership and administrator permissions of the final Squarespace website will transfer to you only after the final invoice balance has been paid in full.
Retained Assets: All unused design concepts, draft layouts, custom graphics, or alternative code options created during development remain the permanent intellectual property of Sarah Foubert, trading as foubography.
Showcasing Work: I reserve the right to feature screenshots, video walkthroughs, or links to your completed website in my portfolio, social media, and digital library to showcase creative work.
9. Accuracy & Final Proofing
It is entirely your responsibility to thoroughly check all website proofs for copy accuracy, spelling, functionality, and layout errors before the site goes live. Sarah Foubert (foubography) is not liable for errors, typos, or broken external links found after you give the final sign-off to launch.
10. Legal Agreement
By confirming your project deposit, booking a template tweak, or purchasing tech support hours with Sarah Foubert, trading as foubography, you acknowledge that you have read, understood, and agreed to these binding Terms & Conditions.
11. Governing Law & Jurisdiction
These Terms & Conditions, and any dispute or claim arising out of or in connection with them (including non-contractual disputes), shall be governed by and construed exclusively in accordance with the laws of England and Wales. Both parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of this agreement.

By booking a session, web design project, template tweak, or tech support with Sarah Foubert, trading as foubography, you agree to the following terms and conditions. These are designed to ensure clarity, fairness, and a transparent, collaborative experience for both of us.
1. Booking & Confirmation
You can book your session by contacting me directly or using the online scheduling system. To secure your booking, a non-refundable deposit of 10% of the total session fee is required. Your booking will be considered officially confirmed only once this deposit has been received. Until the deposit is paid, your slot remains open and may be offered to other clients.
2. Payment & Pricing
For all brand, portrait, and creative photography sessions, the remaining balance is due on or before the day of your session. Payments can be made via bank transfer or credit card as detailed on your invoice. Because these packages represent a flat fee for a complete creative deliverable, rates are non-negotiable and cover the time on location, travel allowances where specified, and post-production editing.
3. Cancellations & Rescheduling
Because I look after a busy schedule of creators and performers, last-minute changes impact my calendar significantly. If you need to reschedule:
More than 48 hours’ notice: You can move your session to a new date without any penalty, and your 10% deposit will slide over to the new date.
Less than 48 hours’ notice: I reserve the right to retain the deposit to cover the lost studio or location slot. Rescheduling will require a new deposit.
No-shows: The session fee will be payable in full. In the rare event that I must cancel due to illness or an emergency, I will give you as much notice as possible, offering an immediate priority reschedule or a full refund of your deposit.
4. Late Arrivals & Time Limits
Please let me know as soon as possible if you are running late. To maintain a relaxed environment and protect my transit logistics, sessions will wrap up at the originally scheduled time. Arriving late cuts directly into your shooting time, which compromises our ability to capture an unhurried look. If you are more than 20 minutes late without notice, the session will be treated as a short-notice cancellation and the deposit will be forfeit.
5. Image Selection & Delivery
Following your session, you will receive access to a secure online proofing gallery to select your final images. The standard delivery timeline for your fully edited, high-resolution digital files is within 7 working days from the moment you submit your final selections via Pixieset, or as explicitly outlined on your invoice. Unedited RAW files represent incomplete work and are never released under any circumstances. Additional edited images outside of your package allotment may be purchased at a flat rate of £25 per image.
6. Image Usage & Professional Licence
I retain the copyright for all images created during your session, as is standard in UK law. You are granted a comprehensive, perpetual professional licence to use, print, and share the final edited images for self-promotion, including your personal website, social media, casting platforms (such as Opera Base), CVs, and editorial use in performance or event programmes.
To preserve the authentic aesthetic of the work, images must not be re-edited, heavily cropped, or subjected to third-party social media filters. Commercial usage rights for retail products, paid corporate advertising campaigns, or third-party business marketing must be arranged in advance via a separate licensing agreement.
7. Portfolio & Promotion
I love sharing the incredible creators I work with. I reserve the right to use selected images from your session on my digital hub, blog, or social media portfolio to showcase my work. If you require your images to remain completely private due to an unannounced project or agency embargo, please let me know in writing prior to our session.
8. Digital Storage & Backup
I keep a backup of your final edited images for six months after delivery. Please download and back up your digital files promptly upon receiving your Pixieset link, as digital storage cannot be guaranteed beyond this six-month window.
9. Creative Collaboration & Environment
My photography style relies entirely on a relaxed, natural environment. No stiff, corporate posing. We will always align your visual aesthetic during our initial planning chat to ensure your gallery seamlessly integrates into your digital hub and prevents content burnout.
10. Legal Agreement
By confirming your booking and paying your deposit with Sarah Foubert, trading as foubography, you acknowledge that you have read, understood, and agreed to these binding Terms & Conditions.

By purchasing an SEO or strategy package with Sarah Foubert, trading as foubography, you agree to the following terms and conditions. These ensure we build a sustainable content framework without the corporate jargon or confusing monthly retainers.
1. Strategy Packages & Deliverables
Scope of Work: Services are strictly limited to the one-off packages outlined in your agreement: the Strategy & Audit Call, the One-Off SEO Kickstart, or the Full Ecosystem Strategy.
One-Off Structure: I do not provide ongoing monthly SEO management or retainer contracts. All work is delivered in three straightforward steps: The under-the-bonnet look, The practical fix, and The handover. Any support requested after the final handover video will be billed under my standard tech support rates.
2. Fees & Payments
Strategy & Audit Call: The flat fee of £250 is payable in full at the time of booking to secure your consultation date.
SEO Kickstart & Full Ecosystem Strategy: A non-refundable 50% deposit is required before I begin your under-the-bonnet look. The remaining 50% balance is due immediately upon delivery of your handover video and before any custom strategy blueprints or frameworks are released.
3. Search Engine Ranking & Algorithm Disclaimer
No Ranking Guarantees: While my strategy is designed to optimise your digital hub and improve visibility, I do not guarantee first-page placement, specific keyword rankings, or immediate traffic spikes on Google.
Third-Party Control: Search engine algorithms change constantly. Sarah Foubert, trading as foubography, is not responsible for drops in traffic, indexing delays, or algorithmic penalties implemented by Google or other search engines after the handover phase is complete.
4. Client Access & Technical Requirements
Platform Access: For the One-Off SEO Kickstart and Full Ecosystem Strategy, you must provide administrator access to your Squarespace site, Google Search Console, and Google Analytics. Delays in providing credentials will delay your practical fix step.
Content Implementation: The Full Ecosystem Strategy relies on a continuous content plan to create a circular rhythm between your website, emails, and socials. I provide the framework and setup, but the execution and maintenance of that content plan are entirely your responsibility.
5. Strategy Call Expiry & Cancellations
Rescheduling: Strategy calls can be rescheduled once with at least 48 hours’ notice.
Expiry: To keep my production schedule moving, your Strategy & Audit Call or your ecosystem 1:1 sessions must be booked and completed within 60 days of your initial payment. Unused sessions beyond this window are forfeit without a refund.
6. Intellectual Property
Strategy Blueprints: All customised frameworks, video handovers, and checklist deliverables prepared for your brand are licensed to you for internal business operations. You may not resell, redistribute, or reuse my proprietary frameworks or audit templates for other businesses.

By purchasing a live support block, minor update, layout round, or subscription with Sarah Foubert, trading as foubography, you agree to the following terms and conditions. These are designed to protect my time and ensure your technical adjustments are completed efficiently without hidden complications.
1. Booking, Fees & Access
Payment Terms: Fees for Minor Site Updates, Live Hourly Tech Support, and Design & Layout Updates must be paid in full at the time of booking to secure your slot in my schedule.
Site Access: You are entirely responsible for providing accurate contributor or administrator access to your Squarespace site and connected platforms prior to The Preparation phase.
Delays: If access is not provided before our scheduled session, the time spent troubleshooting logins will be deducted from your paid support block.
2. The 60-Minute Session & "The Hard Boundary"
Strict Time Limits:Live Hourly Tech Support covers exactly 60 minutes of active design, maintenance, or troubleshooting.
The Hard Boundary: As outlined in my workflow, once the 60-minute mark is reached, work stops immediately. If your technical issue requires deeper investigation or additional backend clean-ups, you must purchase a separate support block or a Follow-Up Call. I will never perform unpaid overtime to compensate for a messy or poorly configured backend.
Scope Limits: Within a 60-minute session, we can only address tasks fitting that window, such as swapping portfolio photos, fixing mobile formatting, or linking email marketing forms. Massive structural overhauls fall under Design & Layout Updates and will be quoted separately.
3. DIY Library & Subscription Access
Billing Cycle:The DIY | Library Access is billed as an ongoing monthly subscription of £4.99 until cancelled by you.
No Refunds: Due to the instant, digital nature of the library materials, templates, and guides, refunds are not available for partial months or unused subscription periods.
Cancellation: You can cancel your subscription at any time through your account portal. Access to the private library and video resources will terminate immediately upon cancellation.
4. Technical Liability & Platform Limitations
Pre-existing Issues: I am responsible only for the specific technical fixes or updates agreed upon during The Preparation phase. I am not liable for pre-existing coding errors, broken links, or configuration mistakes created by you or a previous designer.
Platform Failures: Squarespace, domain hosts, and email marketing tools are third-party platforms. Sarah Foubert, trading as foubography, is not responsible for platform downtime, system bugs, data losses, or API changes that disrupt your site functions during or after our support session.
Backups: While I perform basic backend clean-ups, it is your responsibility to maintain copies of your original site text, graphics, and data before I begin working.

1. Digital Delivery & Instant Access
Instant Performance: All products in the shop (including the Instagram Strategy Starter course, downloadable PDF guides, and digital resources) are delivered instantly via digital download links or email access.

However, by clicking "Purchase" and obtaining immediate access to these digital assets, you explicitly request immediate performance of the contract and agree that you waive your statutory 14-day right to cancel.
2. No-Refund Policy

3. Intellectual Property & Personal Licence
Single-User Licence: When you buy a guide or a course, Sarah Foubert, trading as foubography, grants you a non-exclusive, non-transferable, personal licence to use that material for your own business or creative growth.

4. System Compatibility
Client Responsibility: You are responsible for ensuring you have the necessary software and internet capabilities to download, view, and open the digital file formats provided (such as PDFs or video standard links). I am not liable for technical issues arising from your local device configurations or outdated software.

From time to time, special offers, promotional codes, or seasonal bundles may be introduced. By redeeming any offer or discount code issued by Sarah Foubert, trading as foubography, you agree to the following default terms.
1. Validity & Expiry
Strict Deadlines: Every promotion has a specific, clearly stated validity period. Once that window closes, the offer automatically expires and cannot be extended under any circumstances.
Right to Withdraw: I reserve the right to alter, pause, or withdraw any active promotion, discount code, or introductory package pricing at any time without prior notice or liability.
2. Application & Limitations
New Bookings Only: Promotional discounts apply solely to new bookings, shop purchases, or projects commissioned during the active promotional period. Discounts cannot be applied retroactively to secure deposits already paid, active photography sessions, or web builds currently in progress.
No Stacking: Unless explicitly stated otherwise in writing, promotional codes and offers cannot be combined with any other discounts, custom bundle rates, or ongoing loyalty pricing. Only one discount code can be applied per transaction.
Exclusions: Discounts standardly apply to my creative time and digital deliverables, but cannot be used to offset third-party costs, including Squarespace hosting plans, custom domains, or physical studio hire fees.
3. Non-Transferable
Promotional offers, gift vouchers, and discount codes have no cash value, cannot be exchanged for cash currency, and are non-transferable between different clients, creators, or businesses.
