Terms & Conditions
-
This document defines the terms and conditions of our working relationship.
All projects or services that Sarah Foubert may be contracted to produce or provide for the client will be subject to the following:
Payment & Estimates
The Client agrees to pay a nonrefundable 50% deposit before work will begin. Unless otherwise specified, all balances due are payable upon final art approval and before final files are delivered. The Company reserves the right to refuse completion or delivery of work until past due balances are paid. Billing will reflect the actual costs incurred. Estimates are valid for 30 days from the date on the estimate.
Revisions & Alterations
The Client will be given up to three (3) original design concepts, then two (2) revisions of the chosen design. Concept revisions, extensive alterations, or a switch in design may result in a delayed completion date. If further revisions are requested, the Company will make modifications at a fee of £30.00 per hour. If the Client decides to cancel the order before the order has been fully completed, the Company will retain the non-refundable 50% deposit. If the Client decides to cancel the order after final approval is made, the Company reserves the right to retain the full payment. Work will commence upon the Client’s approval of the estimate through a signed contract and confirmed payment of the 50% deposit. The Client’s approval (electronic or handwritten) constitutes an agreement.
Originality
The Company affirms that designs are original and therefore owns the rights granted under this agreement. Rights granted do not conflict with any other agreement.
Errors & Omissions
It is the responsibility of the Client to check proofs carefully for accuracy in all respects, ranging from spelling to punctuation to technical illustrations. The Company is not liable for errors or omissions. If errors are found after the final approval is made, the cost of a reprint is the responsibility of the Client.
Refunds & Cancellations
Due to the customised nature of the work, it is not possible to offer a refund once an agreement has been made.
Rights of Ownership
The rights to all design and artwork produced by the Company remain with the Company. Unless negotiated with the Company, The Client may not use or reproduce any design or images for a purpose other than the one(s) originally stipulated. If The Client wishes to use the design and/or images within it for another purpose or project, The Company must be contacted to arrange the transfer of rights and any additional fees before proceeding. The Company reserves the right to photograph, distribute, or publish any work created for the Client for promotional and marketing needs.
Term & Termination
The term of this agreement will continue for work in progress until terminated by either party upon written notice. If the Company is at any time directed to cancel or postpone any previously authorised purchase, it will promptly do so, though refunds of any deposits previously made will not be available.
The use & costs of content management systems
Any costs required to set up and use a Content Management System, such as Squarespace or Wix, are to be paid by the Client, as well as any requested add-ons, subscriptions, or other relevant extras. The prices for any extras necessary to fulfil the original terms of the agreement will be included in the fee quoted by the Company.
Termination & OwnershipIf a project is terminated by either party before completion, the client will be invoiced for the work completed to date, based on the agreed hourly or milestone rates. Ownership of any design work or files will only transfer to the client once full payment for completed work has been received and only for the deliverables explicitly agreed upon prior to termination. Unused concepts, drafts, or design files remain the intellectual property of foubography.

By booking a photography session with foubography, you agree to the following terms and conditions. These are designed to ensure clarity, fairness, and a completely relaxed, creative experience for both of us.
1. Booking & Confirmation
You can book your session by contacting me directly or using the online scheduling system. To secure your booking, a non-refundable deposit of 10% of the total session fee is required. Your booking will be considered officially confirmed only once this deposit has been received. Until the deposit is paid, your slot remains open and may be offered to other clients.
2. Payment & Pricing
For all brand, portrait, and creative photography sessions, the remaining balance is due on or before the day of your session. Payments can be made via bank transfer or credit card as detailed on your invoice. Because these packages represent a flat fee for a complete creative deliverable, rates are non-negotiable and cover the time on location, travel allowances where specified, and post-production editing.
3. Cancellations & Rescheduling
Because I look after a busy schedule of creators and performers, last-minute changes impact my calendar significantly. If you need to reschedule:
More than 48 hours’ notice: You can move your session to a new date without any penalty, and your 10% deposit will slide over to the new date.
Less than 48 hours’ notice: I reserve the right to retain the deposit to cover the lost studio or location slot. Rescheduling will require a new deposit.
No-shows: The session fee will be payable in full. In the rare event that I must cancel due to illness or an emergency, I will give you as much notice as possible, offering an immediate priority reschedule or a full refund of your deposit.
4. Late Arrivals & Time Limits
Please let me know as soon as possible if you are running late. To maintain a relaxed environment and protect my transit logistics, sessions will wrap up at the originally scheduled time. Arriving late cuts directly into your shooting time, which compromises our ability to capture an unhurried look. If you are more than 20 minutes late without notice, the session will be treated as a short-notice cancellation and the deposit will be forfeit.
5. Image Selection & Delivery
Following your session, you will receive access to a secure online proofing gallery to select your final images. The standard delivery timeline for your fully edited, high-resolution digital files is within 7 working days from the moment you submit your final selections via Pixieset, or as explicitly outlined on your invoice. Unedited RAW files represent incomplete work and are never released under any circumstances. Additional edited images outside of your package allotment may be purchased at a flat rate of £25 per image.
6. Image Usage & Professional Licence
I retain the copyright for all images created during your session, as is standard in UK law. You are granted a comprehensive, perpetual professional licence to use, print, and share the final edited images for self-promotion, including your personal website, social media, casting platforms (such as Opera Base), CVs, and editorial use in performance or event programmes.
To preserve the authentic aesthetic of the work, images must not be re-edited, heavily cropped, or subjected to third-party social media filters. Commercial usage rights for retail products, paid corporate advertising campaigns, or third-party business marketing must be arranged in advance via a separate licensing agreement.
7. Portfolio & Promotion
I love sharing the incredible creators I work with. I reserve the right to use selected images from your session on my digital hub, blog, or social media portfolio to showcase my work. If you require your images to remain completely private due to an unannounced project or agency embargo, please let me know in writing prior to our session.
8. Digital Storage & Backup
I keep a backup of your final edited images for six months after delivery. Please download and back up your digital files promptly upon receiving your Pixieset link, as digital storage cannot be guaranteed beyond this six-month window.
9. Creative Collaboration & Environment
My photography style relies entirely on a relaxed, natural environment. No stiff, corporate posing. We will always align your visual aesthetic during our initial planning chat to ensure your gallery seamlessly integrates into your digital hub and prevents content burnout.
10. Legal Agreement
By confirming your booking and paying your deposit with foubography, you acknowledge that you have read, understood, and agreed to these binding Terms & Conditions.
