This document defines the terms and conditions of our working relationship.
All projects or services that Sarah Foubert may be contracted to produce or provide for the client will be subject to the following:
Payment & Estimates
The Client agrees to pay a nonrefundable 50% deposit before work will begin. Unless otherwise specified, all balances due are payable upon final art approval and before final files are delivered. The Company reserves the right to refuse completion or delivery of work until past due balances are paid. Billing will reflect the actual costs incurred. Estimates are valid for 30 days from the date on the estimate.
Revisions & Alterations
The Client will be given up to three (3) original design concepts, then two (2) revisions of the chosen design. Concept revisions, extensive alterations, or a switch in design may result in a delayed completion date. If further revisions are requested, the Company will make modifications at a fee of £30.00 per hour. If the Client decides to cancel the order before the order has been fully completed, the Company will retain the non-refundable 50% deposit. If the Client decides to cancel the order after final approval is made, the Company reserves the right to retain the full payment. Work will commence upon the Client’s approval of the estimate through a signed contract and confirmed payment of the 50% deposit. The Client’s approval (electronic or handwritten) constitutes an agreement.
Originality
The Company affirms that designs are original and therefore owns the rights granted under this agreement. Rights granted do not conflict with any other agreement.
Errors & Omissions
It is the responsibility of the Client to check proofs carefully for accuracy in all respects, ranging from spelling to punctuation to technical illustrations. The Company is not liable for errors or omissions. If errors are found after the final approval is made, the cost of a reprint is the responsibility of the Client.
Refunds & Cancellations
Due to the customised nature of the work, it is not possible to offer a refund once an agreement has been made.
Rights of Ownership
The rights to all design and artwork produced by the Company remain with the Company. Unless negotiated with the Company, The Client may not use or reproduce any design or images for a purpose other than the one(s) originally stipulated. If The Client wishes to use the design and/or images within it for another purpose or project, The Company must be contacted to arrange the transfer of rights and any additional fees before proceeding. The Company reserves the right to photograph, distribute, or publish any work created for the Client for promotional and marketing needs.
Term & Termination
The term of this agreement will continue for work in progress until terminated by either party upon written notice. If the Company is at any time directed to cancel or postpone any previously authorised purchase, it will promptly do so, though refunds of any deposits previously made will not be available.
The use & costs of content management systems
Any costs required to set up and use a Content Management System, such as Squarespace or Wix, are to be paid by the Client, as well as any requested add-ons, subscriptions, or other relevant extras. The prices for any extras necessary to fulfil the original terms of the agreement will be included in the fee quoted by the Company.
Termination & OwnershipIf a project is terminated by either party before completion, the client will be invoiced for the work completed to date, based on the agreed hourly or milestone rates. Ownership of any design work or files will only transfer to the client once full payment for completed work has been received and only for the deliverables explicitly agreed upon prior to termination. Unused concepts, drafts, or design files remain the intellectual property of foubography.

By booking a photography session with foubography, you agree to the following terms and conditions. These are designed to ensure clarity, fairness, and a smooth experience for both of us.
1. Booking & Confirmation
You can book your session by contacting me directly or using the online booking system on my website. Once a date and time have been selected, you’ll receive a confirmation email from my scheduling system (Acuity).
To secure your booking, a non-refundable deposit of 10% of the session fee is required. Your booking will be considered confirmed only once this deposit has been received. Until then, your slot remains open and may be offered to others.
2. Payment
The remaining balance is due on or before the day of your session. You’ll receive an invoice with payment details after your deposit is paid. Payment can be made by bank transfer, PayPal, or another method we agree upon in advance.
For branding and commercial work, separate terms may apply and will be discussed individually.
3. Cancellations & Rescheduling
Life happens—I understand! If you need to cancel or reschedule:
More than 48 hours’ notice: You can reschedule without any additional fee. Your deposit will be transferred to your new session date.
Less than 48 hours’ notice: I reserve the right to retain the deposit to cover the lost slot. Rescheduling may require a new deposit.
No-shows: The session fee may still be payable in full.
In the rare event that I need to cancel or reschedule, I’ll give you as much notice as possible and offer a new date or a full refund of your deposit.
4. Late Arrivals
If you’re running late, please let me know as soon as possible. Sessions will still end at the scheduled time unless we’ve agreed otherwise in advance. This is to ensure I stay on time for all clients. If you’re more than 20 minutes late and I haven’t heard from you, I may consider the session cancelled (see above cancellation policy).
5. Image Delivery
After the session, you’ll receive a proofing gallery within the agreed timeframe (usually 1–3 weeks, depending on the type of session). You’ll then select your final images, which I’ll edit and deliver as high-resolution digital files. Print options may also be available.
All delivery times will be outlined during the booking process.
6. Image Usage & Copyright
I retain the copyright for all images created during your session, as is standard in UK law. However, you are granted a personal licence to use and share the final images for personal use (e.g., printing, social media, personal websites).
Images must not be altered (e.g., adding filters or cropping out watermarks) or used commercially without written permission. If you need commercial usage rights (e.g., for a business or brand), we’ll discuss this and include it in your session fee or as an add-on.
I may use selected images from your session on my website, blog, or social media, unless you let me know in writing that you’d prefer I didn’t.
7. Digital Storage & Backups
I keep a backup of your final edited images for at least six months after delivery. Please download and back up your gallery promptly, as I can’t guarantee storage beyond that period.
8. Liability
While I do everything I can to ensure a safe and smooth experience, I can’t be held responsible for any injuries, accidents, or loss of personal items during our session.
In the unlikely event of technical failure, cancellation due to illness, or other unforeseen circumstances, my liability is limited to a full refund of any payments made.
9. Client Responsibility
Please ensure all participants arrive prepared and dressed appropriately for the session. If young children are involved, I recommend bringing snacks, water, and comfort items if needed. You are welcome to share ideas or a moodboard beforehand—I love tailoring sessions to your vision.
10. Agreement
By booking a session with foubography, you acknowledge that you’ve read, understood, and agreed to these Terms & Conditions.
